A pet addendum is a contractual document that provides guidelines and conditions for tenants who may be bringing a pet to a rental property. However, it can also serve to acknowledge that a tenant will not be a bringing a pet to the property, and what the potential repercussions or the steps needed if they wish to do so during the tenancy.
Information to Include
The following information should be included in a Pet Addendum to ensure it is all inclusive:
- Tenant Name
- Property address
- Allowable Pets types and Breeds along with any weight restrictions
- Gender and age of pet
- Pet license information
- Pet Color and Gender
- Pet Deposit Amount
- Pet Rent Amount
- Deposit Amount
- Clause for the tenant’s responsibility regarding the pet and its actions (reducing noise, ensuring the pet does not become a nuisance or disturbance to neighbors, cleaning up waste appropriately, exhibiting acceptable and non-erratic behavior, not damaging the home, chewing carpet, attacking neighbors or guests, etc.).
- Clause regarding the pet and its owner complying with Home Owners Association (HOA) Guidelines, if applicable (picking up waste in common areas, having a leash on, etc.).
- Clause regarding where pet can be kept (i.e., inside or outside of the home) and assuring it will remain in the allowable area(s).
- Clause disclosing that liability falls to the tenant if property is damaged or fines are received from HOA regarding the pet
- Disclosure regarding potential adverse effect if tenant fails to abide by documented guidelines (i.e. responsible for repairs, loss of deposit, eviction, additional penalties assessed upon move out, etc.)
What Does a Pet Addendum Accomplish?
A Pet Addendum provides the tenant with clear and detailed expectations for renting the home with a pet. This also provides the landlord with knowledge of the pet that will be in the home, and that the tenant is aware that they must keep the home in top condition. Because the addendum can be added after the lease is in place, this also provides an opportunity for flexibility. The tenant may obtain a Pet in the middle of the lease and still remain compliant with the overall agreement, as the addendum can be added at any time by the landlord or the tenant (as requested).
How Does a Pet Addendum Affect Your Tenancy
The tenancy can be impacted in various ways for a resident. If the pet poses issues and damages the property, the tenant may be responsible for fixing any damages or providing payment to the landlord for the repairs. In addition, a tenant can face eviction if the pet becomes aggressive, is excessively damaging to the property or causes continuous disturbances that are experienced by other neighbors. However, providing a tenant with a Pet Addendum assures the tenant is aware of expectations and ways to rectify a situation if necessary, thus providing transparency for the care of the home and the pet.
