Disclosure forms are informational documents that are required to be given to a real estate buyer when presenting an offer to purchase property. In all 50 States the Lead-Based Paint Disclosure must be given to buyers of all housing units built prior to 1978. Depending on the State, the seller will be required to submit any other disclosures that are required.

“Buyer Beware” States

In States that are “buyer beware” or commonly known as “caveat emptor”, the seller of the property is not liable for information that is told to the buyer before the purchase. Therefore, no matter what claims the seller makes, the buyer will be responsible for investigating all details about the property. After the sale, the seller will be held harmless from any liability or claims in connection with the property.
